Free Consultations for Workers’ Compensation Cases: Why are they provided? Why should you take advantage

As an Applicant’s Attorney in Workers’ Compensation, our offices offer “free” consultations to prospective clients. One reason that consultations are “free” is that workers’ compensation attorneys do not charge their clients on an hourly basis. Instead, they are paid on a contingency fee basis. A contingency fee agreement means that the attorney is compensated based upon the results obtained. They receive a percentage of the Injured Worker’s recovery. Fees generally run from 9 to 15 percent and are usually determined by the Workers’ Compensation Judge. For example, if the settlement was $10,000.00, the attorney’s fee would be $1,500.00. The injured worker would collect $8,500.00, and the attorney $1,500.00.

A “free” consultation can usually last an hour. Free consultations can also be done over the phone or in person.

There are a number of issues that can be discussed and evaluated. These include:

  • Whether there is a valid work injury claim that should be pursued
  • Whether the services of an attorney would be beneficial in obtaining benefits
  • Whether you believe that this attorney will be responsive to your needs
  • Whether there are additional causes of action that can be pursued beyond workers’ compensation
  • Whether there are additional sources of income or medical care that can be obtained beyond Workers’ Compensation

In order to make your consultation a success, I would recommend that you bring the following items if they are available:

  • A copy of the Workers’ Compensation Claim Form if one has been filed
  • If you were paid by check, a copy of a paycheck from your employer
  • Copies of any medical reports that you may have in your possession
  • Copies of any correspondence from your Employer, Insurance Carrier, or the Workers’ Compensation Appeals Board and
  • Any business cards from doctors, investigators or other people that you have met in connection with your claime.

In sum, as an Injured Worker, you should take advantage of the opportunity to get a “free” consultation. Any knowledge you obtain in that meeting should assist you in the successful handling of your matter.
